Mediation

Mediation is an alternative dispute mechanism whereby a neutral third party facilitates settlement dialogue between parties either before litigation is filed or during the litigation process. 

Many contracts require mediation as a prerequisite to filing a lawsuit, and most courts encourage mediation at some point during the litigation process. 

Most disputes could benefit from the mediation process, but many mediations are unsuccessful because the parties have not identified the right mediator for the dispute. Mediation is generally not binding and the parties to mediation can control whether to settle or not during the process.
